RED ALERT: NO on SB 611

On July 2nd, the California Assembly Judiciary Committee is set to hear a bill by Senator Menjivar (D - Burbank) that was significantly amended to include provisions that are not only unreasonable details of costs associated with renting a unit - but violates the privacy of previous tenants.

Recently, AAOC Ron Kingston penned an opposition letter to the Chair of the Assembly Judiciary Committee - Ash Kalra (D - San Jose) - that details the reasons this bill should be opposed, and the problems it creates.

The problems with this bill include:

  • Gives current renters - or their representatives - a right to inspect records related to former renters utility bills.
  • Requires all costs associated with renting a unit to be displayed in all advertising - regardless of size or purpose of advertising, and regardless of what the cost is - pet fees, parking fees, laundry fees - and regardless of whether or not they are comparable between tenants.
  • Makes the property owner liable if the renter doesn't understand the fees - resulting in a breach of the residential rental contract.

AAOC has launched a Red Alert for all members to contact the members of the judiciary committee. We ask all AAOC members to reach out to the Assembly Judiciary Committee members with the instructions listed below:

I am a member of the Apartment Association of Orange County. I own and/or manage rental property in California. I am opposed to Senator Caroline Menjivar’s Senate Bill 611, as amended.

 

While I may not be a constituent, this proposed litigation would expose all California property owners to government overreach when advertising a residential rental unit for rent; it also permit renters to materially breach rental contracts by interpreting its over-broad provisions as an affirmative defense to do so.

 

Please vote no on Senator Caroline Menjivar’s Senate Bill 611.
